Welcome to the websites and/or any other digital platforms of the Edmond Benjamin de Rothschild Foundation websites, located at 104 Rothschild Boulevard, Tel Aviv (hereinafter: “the Foundation”) available at the following addresses: https://www.edrf.org.il/ (“the Main Website”) and https://edrcenter.com/ (“the Center Website”) and/or any other digital platforms (collectively: “the Websites”).

Please note: Use of the Websites is subject to these Terms of Use, and any use of the Websites constitutes your agreement to be bound by them. If you do not agree to any provision of these Terms of Use, you must immediately cease using the Websites.

By accessing and/or using the Websites in any manner, you represent that you have carefully reviewed these Terms of Use prior to such access or use, that you agree to be bound by all of their terms and provisions, and that neither you nor anyone acting on your behalf shall have any claim, demand, or cause of action arising from or relating to these Terms of Use.

  1. General

    • The Foundation operates a variety of activities and programs. The Main Website provides information about its activities in the areas of access to higher education, academic excellence, art, impact entrepreneurship and leadership, as well as other services that may be offered on the Main Website from time to time. The Center Website provides information about the activities of the Edmond de Rothschild Center (operated by the Foundation), including programs of professional training and development for artists and designers, exhibition and event production, and other services as offered on the Website from time to time. Information regarding the activities of the Foundation can be found on the relevant website.
    • The information provided on the Websites is not intended to constitute investment advice or advice of any other kind, nor is it intended to provide definitive guidance regarding the activities of the Foundation and/or the obligations arising from any contractual or other relationship you may have with the Foundation, if any. The Website may, from time to time, include additional functions, such as the submission of information to the Foundation’s institutions.
    • The Foundation reserves the right to update the Terms of Use from time to time, at its sole discretion and without prior notice. Any update to the Terms of Use shall take effect immediately upon its publication on the Websites (in the updated version at any given time). You are advised to review these changes frequently.
    • The purpose of these Terms of Use is to regulate the relationship between the Websites and any organization, entity, or other party, including anyone acting on their behalf, who accesses or uses the Websites (the “User” or “You”). For the purposes of these Terms of Use, “Automated Use” means any use of the Websites that is not carried out directly by a human being, including use through software, scripts, bots, agents, artificial intelligence tools, or any other technological means.
    • These Terms of Use shall apply to the use of the Websites on any computer or other communication device the User chooses to use (e.g., mobile phone, tablet, laptop, etc.).
    • The Foundation may, from time to time, update the technologies, interfaces, and functionalities of the Websites. The User agrees that these Terms of Use shall apply to any future version of the Websites, unless stated otherwise in the updated Terms of Use.

 

  1. Right of Use

    • The use of the Websites and all their content is provided on an “as is” and “as available” You shall have no claim, demand, or cause of action against the Foundation and/or anyone acting on its behalf with respect to the features of the Websites and their content, or the accuracy, completeness, timeliness, and reliability of the content, the capabilities of the Websites, any limitations thereof, or their suitability for Your needs, including with respect to any temporary or permanent discontinuation of the Websites, the failure to retain and/or loss of content (including content sent to or by You), or any impairment, corruption, or alteration of the integrity or substance of content received or transmitted by You. The Foundation does not undertake to provide technical support in connection with any such malfunction or disruption.
    • The Foundation does not undertake that all services currently offered through the Websites, or that may be offered through them in the future, will continue to be available. Any service may be modified, suspended, or discontinued without prior notice, subject to applicable law.
    • The Foundation does not warrant that the use of the Websites or the services provided through them will be uninterrupted or immune from unauthorized access to the Foundation’s systems, nor that they will meet Your requirements. Despite reasonable efforts that may be made, the Foundation does not warrant that any defect or deficiency in the Websites will be corrected. The Foundation shall not be liable for any damage, whether direct or indirect, inconvenience, or any similar harm that may be caused to You or Your property as a result thereof.
    • The Foundation may, at its sole discretion, implement technical and legal measures to prevent Automated Use of the Websites, including blocking access, imposing rate limits, or employing any other measure. The Foundation may restrict or terminate access to the Websites for any User of violating these Terms of Use, without prior notice.

 

  1. Prohibited Activities

The Foundation reserves the full right to remove or edit, in whole or in part, any content that violates the provisions of this Section or these Terms of Use generally, and to block any User, as it deems appropriate and at its sole discretion, all without prior notice. In order to protect the Websites, their Users, the Foundation, and third parties, Users are prohibited from engaging in any of the following activities: Impersonating any person or entity, including any representative, employee, or director of the Foundation, falsely claiming to possess a particular status or characteristic, providing misleading information, or otherwise misrepresenting Your affiliation with any third party.

  1. Uploading, sending, or transmitting any content that is unlawful and/or intended for unlawful purposes, including: (1) False and misleading material, or material intended to deceive any person or entity, whether directly or indirectly; (2) Offensive content, including profanity, racism, discrimination, hate speech, shaming, threats, defamatory statements, or libelous content; (3) Content that infringes upon the privacy of another person; (4) Content whose upload infringes the intellectual property rights of any third party; (5) Content of a commercial nature and/or content containing any form of advertisement material.
  2. Uploading, sending, or transmitting any material containing a computer virus or any other computer code designed to disrupt, damage, or limit the use of (including any use other than fair and reasonable use of the service) any computer, server, hardware, and/or software used by the Foundation in connection with the provision of the services offered through the Websites. In addition, You may not use or permit the use of any software application or other means, whether manual or automated, including robots, spiders, agents, crawlers, bots, or similar technologies, for the purpose of accessing the Websites, collecting information (whether generally or systematically), searching, scanning, copying, scraping or automatically retrieving content from the Websites. For the avoidance of doubt, no such means may be created or used for the purpose of compiling, aggregating, or creating any collection containing content and/or information obtained from the Websites.
  3. Using artificial intelligence tools, machine learning technologies, or any similar technology to process, analyze, mine, summarize, train on, fine-tune, or otherwise utilize any content available through the Websites, or use the content of the Websites for the training, fine-tuning, enrichment, or improvement of models, without the Foundation’s prior written consent.
  4. Distributing spam to the Websites’ servers, through the Websites, or by means of any other electronic mail system.
  5. Modifying, processing, copying, scraping, adapting, sublicensing, translating, selling, reverse engineering, decompiling, or disassembling the source code of any component of the Websites, including any database, as well as performing any such actions with respect to the hardware or software used in connection with the services.
  6. Infringing, in any manner, any copyright, trademark or other proprietary right in the Websites, whether belonging to the Foundation or to any third party.
  7. Using the Websites for the purpose of impersonating or harassing another individual in any way.
  8. Overburdening any of the Websites’ or Foundation’s systems.
  9. Using the Websites in any manner that violates the terms or agreements of any third party, or in any manner that may expose the Foundation to claims or demands by a third party.

 

  1. Copyright
    • All copyrights and ownership rights connected with the Websites and the information appearing therein, including any patents, designs, services offered or that may be offered through the Websites, as well as the domain name, trade secrets, trademarks, website design, and graphic elements appearing therein, are owned by the Foundation. The User is granted only a limited right to make fair personal use of the Websites, subject to these Terms of Use and applicable law, and not for any commercial purpose.
    • Without the Foundation’s prior written consent, You may not modify, copy, distribute, transmit, display publicly, perform publicly, reproduce, process, create derivative works from, publish, sell, lease, or transmit to any third party, whether directly or through a third party, any part of the Websites by any means or method whatsoever, including electronic, mechanical, optical, photographic, recording, or any other means or technology.
  2. Links

The Foundation is not responsible for the content of any websites linked to from the Websites, nor for the quality of any services provided through such websites and shall bear no liability whatsoever in connection with them. The inclusion of any link on the Websites shall not be construed as a recommendation of the linked website, and they are provided solely for the convenience of the User. You acknowledge and agree that any access to these websites, including any communications with their operators, is undertaken entirely at Your own responsibility.

  1. Indemnification

Upon first demand, You agree to indemnify the Foundation, its employees, partners, shareholders, subsidiaries, advisors, suppliers, and any persons acting on its behalf from and against any and all claims, demands, damages, losses, loss of profits, payments, or any expense – including reasonable attorneys’ fees and legal expenses – arising out of or related to Your breach of these Terms of Use and/or any violation of applicable law by You or by anyone acting on Your behalf, and/or any claim and/or demand brought by a third party as a result of any breach of these Terms of Use.

  1. Personal Information

The Websites process personal information as described in the Privacy Policy available at https://www.edrf.org.il/privacy-policy/. You acknowledge and agree that the Foundation may store and process information relating to Your use of the Websites, including for the purposes of improving the services, maintaining the security of the Websites, and preventing misuse, all in accordance with the Privacy Policy.

  1. Additional Terms

Without limiting the foregoing, the Foundation may provide data, services, and/or additional products through the Websites, and may terminate or discontinue any data, service, or product that is currently available or that may become available through the Websites in the future. The Foundation further reserves the right to establish additional and/or alternative terms applicable to any current or future data, service, or product made available through the Websites (the “Additional Terms”). Unless expressly stated otherwise, such Additional Terms shall be deemed an integral part of these Terms of Use. In the event of any conflict between these general Terms of Use and any specific Additional Terms, the applicable Additional Terms shall prevail.

  1. Liability
    • The Foundation shall not be liable in any manner for any defects, deficiencies, and/or mistakes of any kind in the information made available through the Websites.
    • The Foundation shall not be liable, whether directly or indirectly, for any damage and/or loss, whether direct or indirect, arising from the use of the Websites, their content and/or any services provided through them, or from any inability to use the Websites for any reason whatsoever. The Foundation shall likewise bear no responsibility for software-related damage or any other damage resulting from the use of the Websites.
    • The Foundation makes no warranty that the Websites or their use satisfies, or will satisfy, any particular need of any User, and shall not be responsible for the suitability of any information for a User’s specific purposes.
    • The information available through the Websites does not constitute a replacement for legal counseling and/or treatment, professional or otherwise. Any reliance on such information is solely the User’s own responsibility. Users should not act upon information contained in the Websites without exercising independent judgment and conducting appropriate verification.
    • In the event of any inconsistency between information appearing on the Websites and information contained in the Foundation’s official publications, the latter shall prevail and shall be the authoritative source.
    • Without limiting the foregoing, even if the Foundation or anyone acting on its behalf is found liable for any damage, the User’s exclusive compensation and remedy with respect to any dispute relating to the Websites, their content, or any services provided through them shall be limited to the amount, if any, actually paid by the User to the Foundation for the relevant use of the Websites or services.
    • The Foundation shall not be liable for any failure to perform, or delay in performing, its obligations where such failure or delay results from circumstances beyond its reasonable control, including natural disasters, war, communication failures, power outages or other force majeure events.Top of FormBottom of Form
  2. Minors

The Websites are intended for use by adults only. By using the Websites, You warrant that You are at least 18 years of age. If You do not meet this age requirement, You must cease all use of the Websites and exit them without delay.

  1. Dispute Resolution

These Terms of Use and their interpretation shall be governed by the laws of the State of Israel (without regard to its conflict-of-laws principles). The competent courts located in Tel Aviv-Jaffa shall have exclusive jurisdiction over dispute relating to these Terms of Use.

For the avoidance of doubt, any communication sent to the Foundation, whether through the “Contact Us” form on the Main Website or by email, shall not be confidential. Such communications may be accessible to Foundation personnel and may be shared with third parties for handling.
